Welcome to Recipes We Share (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, web application, and related services (collectively, the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@recipesweshare.com if you become aware of any unauthorized use of your account.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms.

• Upload or share unlawful, harmful, threatening, abusive, or defamatory content.
• Infringe the intellectual property, privacy, or other rights of third parties.
• Send unsolicited communications or harvest personal information from other users.
• Attempt to gain unauthorized access to the Service or related systems.
• Reverse engineer, decompile, or disassemble the Service.
• Use the Service in a way that could damage, disable, or impair it.
• Use automated tools to access or extract data without our written consent.

4. Your Content

The Service allows you to upload, submit, store, and share content such as recipes, photos, text, and files. You retain ownership rights in your User Content. By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display your User Content solely for the purpose of operating and providing the Service to you and your household members.

5. Intellectual Property

The Service and its original content, features, and functionality, including software, design, text, graphics, logos, and icons, are and will remain the exclusive property of Recipes We Share and its licensors, protected by copyright, trademark, and other intellectual property laws.

“Recipes We Share” and associated logos are our trademarks. Nothing in these Terms grants you any right to use our trademarks, logos, or trade names.

6. AI-Generated Content

Certain features of the Service use artificial intelligence to generate content on your behalf, including extracted recipe text and generated photos. AI-generated content is provided for your personal use within the Service. You are responsible for reviewing and verifying any extracted recipe information before relying on it.

7. Subscriptions and Billing

Certain features of the Service require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis depending on the plan you select. All fees are non-refundable except where required by law or as expressly stated in our refund policy.

If your payment fails, we may suspend access to paid features until payment is received. You can cancel your subscription at any time, and cancellation takes effect at the end of your current billing period.

8. Termination

You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your access if we believe you have violated these Terms or if continued access would harm the Service or other users.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Recipes We Share and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the greater of the amount you paid us in the twelve months prior to the event giving rise to the claim or $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Recipes We Share and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your use of the Service, or your violation of these Terms.

12. Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or platforms. Your interactions with third-party services are governed by those services' own terms and policies.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and notify you of material changes before they take effect.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration, except where either party seeks injunctive or other equitable relief to protect intellectual property rights.
